Some couples elect to have a Premarital Agreement prepared before they marry. Such an agreement addresses possible future issues such as income, inheritances, gifts, and a division of assets. Having a Premarital Agreement in place prior to marriage can help avoid expensive and confrontational divorce litigation should the relations end. It may seem obvious, but a premarital agreement must be signed by both parties BEFORE they are married. Agreements made after marriage are called "post nuptial" agreements. The effect of a post nuptial agreement in Oregon is a grey area in the law.
